Purchase and sale agreement

1. The User shall be entitled, without specifying the reason or incurring any additional expenses, to withdraw from a distance contract or a contract concluded outside the commercial premises within fourteen days, except for the cases set forth in section 2.

2. The User's right to withdraw from a distance contract or a contract concluded outside the commercial premises shall not apply to the following contracts:

1) service contracts, under which the services have been fully rendered to the User, provided express consent and acceptance has been given by the User prior to providing the services that the User would lose the right to withdraw from the contract upon complete fulfilment of the contract by the Vendor;

3) contracts for the products custom-made according to specific instructions of the User, which are not produced in advance and are made in accordance with personal selection or instruction of the User, or for the products which are clearly tailored to personal needs of the User;

4) contracts for perishable goods or goods with short expiration time;

5) contracts for packaged goods, which were unpacked after delivery and are unsuitable for returning due to health or hygiene reasons;

6) contracts for the goods, which are inextricably mixed with other objects after delivery due to their nature.

3. The period for withdrawal from a distance contract or a contract concluded outside the commercial premises shall expire in fourteen days:

1) in case of a sale and purchase contract – from the day the User or the person specified by the User, except for the carrier, receives the ordered item or:

a) in case the User orders more than one item and they are delivered separately – from the day the User or the person specified by the User, except for the carrier, receives the last item;

b) in case the goods are delivered in different batches or parts – from the day the User or the person specified by the User, except for the carrier, receives the last batch or part;

c) in case of a contract for regular delivery of the goods within a set time period – from the day the User or the person specified by the User, except for the carrier, receives the first item.

4. If the Vendor failed to present the User with the information about the right to withdraw from the contract in accordance with paragraph 7 of section 1 of Article 6.2287 of the Civil Code (CC) of the Republic of Lithuania, the User shall be entitled to withdraw from the contract within 12 months after the expiry of the period set forth in section 3 of this Article.

5. If the Vendor presents the User with the information set forth in paragraph 7 of section 1 of Article 6.2287 of the CC of the Republic of Lithuania within 12 months after the expiry of the period set forth in section 3 of this Article, the period for withdrawal from the contract shall expire in 14 days after the day the User receives such information.

6. The User shall inform the Vendor about the withdrawal from a distance contract or a contract concluded outside the commercial premises:

1) by presenting a duly completed sample withdrawal form. This form shall be approved by the Government of the Republic of Lithuania or its authorised institution; or

2) by making any other unequivocal statement setting out their decision to withdraw from the contract.

7. The burden of proof of compliance with the requirements of this Article for withdrawal from contract lies with the User.
